POSITION ANNOUNCEMENT

DEPUTY CITY ATTORNEY

REAL PROPERTY & ENVIRONMENT DIVISION

MUNICIPAL LAW BRANCH

SALARY RANGE: $107,991 - $206,524


POSITION:                       The Office of the City Attorney is seeking an experienced transactional attorney in the Real Property & Environment Division of the Municipal Law Branch.

 DIVISION:                        The Real Property & Environment Division provides legal advice and services to the Mayor and the City Council as well as various City departments on a broad range of real estate matters, including the City’s ownership, acquisition, disposal and use of real property; and on environmental matters, including the California Environmental Quality Act (CEQA).  These services include drafting leases, contracts, ordinances and other transactional documents.  Attorneys in the Division also litigate real estate disputes involving direct and inverse condemnation, unlawful detainer, landlord/tenant, quiet title and environmental laws. 

DUTIES AND RESPONSIBILITIES:      The attorney assigned to this position will primarily be responsible for drafting real estate transactional documents, including real estate/development contracts implementing public-private partnerships, purchase and sale agreements, leases, Requests for Proposals/Requests for Qualifications, easement agreements and other real estate transfer documents.  The position also includes advising City departments, Council Offices, and the Mayor’s office on a broad range real estate matters; appearing at commission, committee and Council meetings.  The position may also require handling litigation as needed.

QUALIFICATIONS:         Applicants for this position must have a license to practice law in all of the courts in the State of California. Additional requirements include:

·         Minimum four (4) years real estate transactional experience in the State of California;

·         Demonstrated competency in complex areas of the law;

·         Solid research and writing skills;

Experience and/or proficiency in the following areas is highly desired:

·         Negotiating and drafting purchase and sale agreements

·         Negotiating and drafting office leases, commercial leases, and ground leases

·         Drafting easement agreements and other real estate transactional documents

·         Negotiating, drafting and implementing Public-Private Partnership agreements relating to real estate development projects

·         Civil litigation

·         Representation of governmental agencies

·         Municipal and/or government law such as the

Ralph M. Brown Act and Public Records Act

·         Working closely with public officials, agency personnel and members of the public;

·         Ability to work efficiently and make decisions practically and independently;

·         Strong oral communication skills;

·         Experience in the remaining substantive areas of law that comprise the Division’s practice areas, as described above.

 

 

WRITING SAMPLE:        Applicants are required to submit 3 writing samples demonstrating competency as to the qualifications listed above.

 

 

PROBATION:                  Appointment to this exempt position (non Civil-Service) will be subject to a two (2) year probationary period as required by Section 1050 of the City Charter.  Successful completion of the two (2) year probationary period will result in tenure with the office.
